TERMS OF SERVICE

Welcome to the online platform operated by Evolve Entertainment LLC ("we," "us," "our"). By accessing, viewing, or purchasing photos through our site, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you do not agree to these Terms, you may not access or use our services.

  1. USE OF OUR SERVICES

You agree to use our platform solely for lawful purposes and in accordance with these Terms. You must not:

  • Attempt to download, copy, screenshot, screen-record, or redistribute any photos without purchasing them or obtaining explicit written permission from Evolve Entertainment LLC.

  • Modify, alter, edit, crop, filter, or create derivative works from any photos.

  • Remove, obscure, or alter any watermark, copyright notice, or proprietary marking.

  • Use our photos for unlawful purposes or in any manner that infringes upon the rights of others.

  • Share, transmit, or distribute gallery access credentials, links, passwords, or download files to any third party without our prior written consent.

  • Use any automated system, bot, scraper, or other means to access, copy, or extract content from the platform.

  1. OWNERSHIP AND INTELLECTUAL PROPERTY

All photos, images, videos, and other content displayed or sold on our platform are the exclusive property of Evolve Entertainment LLC and are protected by United States copyright law, the Copyright Act of 1976 (17 U.S.C. ยง 101 et seq.), and applicable intellectual property laws. Purchasing, downloading, or viewing photos does not transfer copyright ownership or any other intellectual property rights.

Unless otherwise agreed upon in a separate written agreement signed by an authorized representative of Evolve Entertainment LLC:

  • Personal Use Licenses: Purchased photos are licensed for personal, non-commercial use only, including personal display, printing for personal use, and sharing on personal social media accounts with proper credit to Evolve Entertainment LLC where reasonably possible.

  • Commercial Use Licenses: Any commercial, promotional, advertising, editorial, or business use requires a separate written licensing agreement and additional licensing fees.

Unauthorized use, reproduction, distribution, public display, or modification of our photos is strictly prohibited and may result in civil and criminal penalties under applicable law.

  1. PURCHASES AND PAYMENT

  • All prices are listed in U.S. Dollars unless otherwise noted.

  • Full payment is required at the time of purchase.

  • All applicable taxes are the responsibility of the purchaser unless otherwise stated.

  • All sales are final. Refunds, exchanges, or credits will only be granted at the sole discretion of Evolve Entertainment LLC.

  • We reserve the right to refuse, cancel, or limit any order at our sole discretion, including in cases of suspected fraud, pricing errors, or violations of these Terms.

  1. DIGITAL DOWNLOADS AND DELIVERY

If you purchase digital products:

  • Downloads will be made available immediately or within a reasonable time following confirmation of payment.

  • It is your sole responsibility to download, save, and back up any purchased files in a timely manner.

  • Download links may expire after a designated period. Re-issuance of expired download links is at our sole discretion and may be subject to a service fee.

  • We are not responsible for lost, deleted, corrupted, or inaccessible files once delivery has been completed.

  • You are responsible for ensuring you have adequate device storage, internet connectivity, and software to access and use downloaded files.

  1. PHOTO PRESENTATION AND VARIATIONS

We make every effort to accurately display our photos. However, colors, tones, brightness, contrast, and overall appearance may vary depending on your device screen, monitor calibration, browser settings, or printer configuration. We cannot guarantee that your device's display will accurately reflect the actual appearance of digital or printed products. Variations in display or print output do not constitute grounds for refund or exchange.

  1. PRINT PRODUCTS

If you purchase physical print products through our platform:

  • Print products are produced by third-party print fulfillment providers.

  • Estimated production and shipping timelines are approximate and not guaranteed.

  • Risk of loss and title for print products pass to you upon delivery to the carrier.

  • Claims for damaged, defective, or incorrect print products must be submitted in writing within seven (7) days of delivery, accompanied by photographic evidence.

  1. PROHIBITED USES

You may not use our photos for:

  • Resale, redistribution, sublicensing, or transfer without explicit written licensing.

  • Submission to stock photography sites, contests, or third-party platforms claiming authorship.

  • Use in connection with artificial intelligence, machine learning training datasets, or generative AI model training.

  • Trademark, logo, branding, or commercial identity creation without written authorization.

  • Any unlawful, defamatory, obscene, pornographic, harassing, discriminatory, or otherwise harmful purpose.

We reserve the right to suspend or terminate access, revoke licenses, and pursue all available legal remedies if prohibited uses are identified.

  1. GALLERY ACCESS AND PASSWORDS

  • Galleries may be password-protected. You are responsible for maintaining the confidentiality of any access credentials provided to you.

  • You agree not to share gallery links, passwords, or access credentials with unauthorized third parties.

  • We reserve the right to revoke gallery access at any time for any reason, including but not limited to violations of these Terms or expiration of the gallery's availability period.

  • Galleries are made available for a limited time and may be archived or removed at our discretion. We recommend downloading purchased files promptly.

  1. ACCOUNT REGISTRATION

If account registration is required to access certain features, you agree to provide accurate, current, and complete information and to maintain and update such information as needed. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Evolve Entertainment LLC, its members, officers, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your access to or use of the platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your unauthorized use, reproduction, or distribution of any photos or content.

  1. DISCLAIMER OF WARRANTIES

THE PLATFORM AND ALL PHOTOS, CONTENT, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Evolve Entertainment LLC shall not be liable for:

  • Any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, our platform, products, or services.

  • Any loss of data, files, profits, revenue, business opportunities, or goodwill.

  • Any unauthorized access to or use of your personal information by third parties.

  • Any errors, omissions, interruptions, delays, defects, or failures in the platform or in delivery of digital or physical products.

Our total cumulative liability arising out of or relating to these Terms or your use of the platform shall not exceed the total amount you paid to Evolve Entertainment LLC for the applicable product or service giving rise to the claim during the six (6) months immediately preceding the event giving rise to such liability.

  1. TERMINATION

We reserve the right to suspend, restrict, or terminate your access to the platform at any time, with or without notice, for any reason, including without limitation any violation of these Terms. Upon termination, your right to access purchased content may be revoked. Provisions relating to intellectual property, indemnification, limitation of liability, and governing law shall survive termination.

  1. PRIVACY

Your use of our platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

  1. CHANGES TO TERMS

We reserve the right to update, modify, or revise these Terms at any time without prior notice. The "Effective Date" listed at the top of these Terms will indicate when the Terms were last updated. Your continued use of the platform following the posting of revised Terms constitutes your acceptance of and agreement to the changes. It is your responsibility to review these Terms periodically.

  1. GOVERNING LAW AND VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the platform, or any photos or services provided shall be brought exclusively in the state or federal courts located in Alabama, and the parties hereby consent to the personal jurisdiction and venue of such courts.

  1. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

  1. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any separate written agreements between you and Evolve Entertainment LLC, constitute the entire agreement between you and Evolve Entertainment LLC regarding your use of the platform and supersede all prior or contemporaneous understandings, agreements, or communications.

  1. WAIVER

The failure of Evolve Entertainment LLC to enforce any provision of these Terms shall not constitute a waiver of such provision or of any other provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Evolve Entertainment LLC.
